Simply Put, So you know exactly Who is being represented by the Real Estate Agent.

Years ago when Buyers spoke to Agents about purchasing a Home, They would naturally presume that Agent was representing them. Why wouldn't they ?  Well..... Here's the truth. Up Until November 25th, 1999, ALL agents represented the SELLER (in regards to Residential Real Estate) .   Surprised........  So were the buyers!

On November 25th, 1998, Governor Tom Ridge signed into law what is commonly refered to as the "CONSUMER NOTICE"

Before you disclose any information to a licensee, be advised that unless you select an agency relationship the licensee is NOT REPRESENTING YOU. A business relationship of any kind will NOT be presumed but must be established between the consumer and the licensee.

Whenever you have a "substantive discussion about real estate"  with a Licensed Agent, That agent is required by Law to Present or Discuss the "CONSUMER NOTICE" 

This is NOT a contract but a discloure so that you know you have a CHOICE to be represented and it what capacity. 

If your agent has had a Substantive Discussion with you about Real Estate & has not Provided you this notice, They have broken the law.

Consumer Notice

Section 608 of the Act requires that licensees provide consumers with the Consumer Notice at the initial interview.  The Notice was published in the Pennsylvania Bulletin on January 8, 2000.

AGENCY DISCLOSURE ACT 112 OF 1998

Act 112 was signed into law as Act 112 by Governor Tom Ridge on November 25, 1998. It will become effective on November 25, 1999. The law amends the Real Estate Licensing Act by (1) requiring a detailed, initial interview agency disclosure statement; (2) defining the various types of agency and the duties owed (3) defining general duties to the consumer; (4) incorporating the concept of "designated agency;" and (5) statutorily authorizing dual agency.
